OVERVIEW
Welcome to Brera Studio. The terms "we", "us" and "our" refer to Brera Studio. Brera Studio operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Brera Studio is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (the "Terms"), describe your rights and responsibilities when using the Services.

Please read these Terms carefully. Nothing in these Terms excludes or limits any mandatory rights granted to consumers under applicable consumer protection law.

By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree to them, you should not use the Services.

SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you confirm that you have the legal capacity required under the law applicable to you to enter into transactions through the Services.

To use certain Services, including purchasing products, you may be required to provide information such as your email address and billing, payment and shipping information. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account. You may not transfer, sell, assign or license your account to another person.

SECTION 2 — OUR PRODUCTS
We make reasonable efforts to present our products and their characteristics — including materials, dimensions, colour and condition — as accurately as possible, both in text and in photographs. Because our catalogue includes archival, vintage and pre-owned pieces alongside new items, colours and finishes may vary slightly from what is displayed on your screen due to lighting, photography and monitor settings.

Some product images use a setting or backdrop generated with the help of AI to set the mood of the photograph; in every case, the product itself shown is the real, unaltered item and is never retouched or altered. Further detail on our photography is available on our "Our Philosophy" page.

Each product is unique or available in extremely limited quantity. We reserve the right, at any time, to limit the quantities of any products that we offer, to discontinue any product, or to correct any errors, inaccuracies or omissions, including after an order has been submitted, without incurring any liability beyond a full refund of the amount paid for the affected item.

SECTION 3 — PRICES AND PAYMENT
All prices displayed on the Services are stated in Romanian Lei (RON) and are inclusive of applicable Value Added Tax (VAT), unless otherwise indicated. Prices do not include any customs duties, import taxes or similar charges that may apply if products are shipped outside the country of purchase.

We reserve the right to change prices for products displayed on the Services at any time, and to correct pricing errors that may occur even after an order has been placed. If a product's correct price is higher than the price stated at the time of your order due to a typographical or technical error, we will contact you for instructions before dispatching the product, or cancel the order and notify you of the cancellation.

Payment must be made in full at the time of ordering, through the payment methods made available at checkout. Payments are processed through Shopify and its payment partners; we do not store your full payment card details. Title and risk of loss in a product pass to you upon delivery.

SECTION 4 — SHIPPING AND DELIVERY
Shipping is currently available only within Romania. Delivery times, costs and other shipping terms are described in our Shipping Policy, which forms part of these Terms.

Delivery estimates are provided in good faith and are not guaranteed; they may be affected by circumstances beyond our reasonable control, including courier delays, customs processing or force majeure events.

SECTION 5 — RETURNS, WITHDRAWAL AND REFUNDS
If you are a consumer purchasing from within the European Union, you have a statutory right of withdrawal and a right to a refund for faulty or non-conforming goods, as further described in our Refund Policy, which forms part of these Terms. Nothing in these Terms limits or excludes these statutory rights.

SECTION 6 — INTELLECTUAL PROPERTY
The Services and their entire content, features and functionality — including but not limited to text, graphics, photographs, logos, the Brera Studio name and any related trademarks — are owned by or licensed to Brera Studio and are protected by applicable intellectual property and unfair competition laws.

Product names, brand names, logos and trademarks referenced or shown on the Services belong to their respective owners. Their appearance on the Services does not imply any affiliation with, endorsement by, or sponsorship from those brands, except where we are an authorized reseller or distributor of the relevant product.

You may not reproduce, distribute, modify, publicly display or otherwise exploit any content from the Services without our prior written consent, except as necessary to make personal, non-commercial use of the Services.

SECTION 7 — USER CONDUCT
You agree not to use the Services for any unlawful purpose, to attempt to gain unauthorized access to our systems, to interfere with the proper functioning of the Services, or to submit false, misleading or fraudulent information, including in connection with an order or a return.

We reserve the right to refuse service, cancel orders, or terminate access to the Services, at our discretion, to anyone we reasonably suspect of violating these Terms or engaging in fraudulent or abusive conduct.

SECTION 8 — LIMITATION OF LIABILITY AND DISCLAIMERS
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, except for those which cannot be excluded or limited under applicable consumer protection law.

To the maximum extent permitted by applicable law, Brera Studio shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the Services. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.

SECTION 9 — GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Romania, without regard to its conflict-of-law provisions, save that if you are a consumer resident in another European Union member state, you also benefit from any mandatory consumer protection provisions of the law of your country of residence.

Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Romania, without prejudice to your right, as a consumer, to bring proceedings before the courts of your own country of residence, or to use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

SECTION 10 — CHANGES TO THESE TERMS
We may update or modify these Terms at any time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms.
